الشروط والأحكام - منصة تولزي (TOOLZZY)

مرحباً بكم في منصة تولزي (Toolzzy). باستخدامكم للموقع الإلكتروني (www.toolzzy.com)، أو التطبيق، أو المتجر الإلكتروني، أو مجتمع تولزي، أو الدورات التدريبية (يُشار إليها مجتمعة بـ "المنصة")، فإنكم توافقون على الالتزام بالشروط والأحكام التالية.

يرجى قراءة هذه الشروط بعناية قبل البدء في استخدام المنصة. في حال عدم موافقتكم على أي جزء منها، يجب عليكم التوقف عن استخدام المنصة فوراً.

1. مقدمة وأهلية الاستخدام

1.1 المنصة: يتم تشغيل منصة "تولزي" بواسطة تولزي للتجارة ، وهي شركة مسجلة في جمهورية مصر العربية.

1.2 الأهلية: باستخدامك للمنصة، فإنك تقر بأن عمرك لا يقل عن 18 عاماً، أو أنك تستخدم المنصة تحت إشراف أحد الوالدين أو الوصي القانوني.

1.3 الاتفاقية: تشكل هذه الشروط اتفاقاً قانونياً ملزماً بينك ("المستخدم" أو "العميل" أو "العضو") وبين منصة "تولزي".

2. حسابات المستخدمين

2.1 التسجيل: للوصول إلى ميزات معينة (المتجر، الدورات، المجتمع)، يجب إنشاء حساب. تلتزم بتقديم معلومات دقيقة ومحدثة.

2.2 الأمان: أنت المسؤول الوحيد عن الحفاظ على سرية بيانات حسابك وكلمة المرور، وعن كافة الأنشطة التي تتم من خلال حسابك.

2.3 إنهاء الحساب: تحتفظ "تولزي" بالحق في تعليق أو إغلاق أي حساب ينتهك هذه الشروط أو يمارس أنشطة مشبوهة أو غير قانونية.

3. شروط المتجر الإلكتروني والتجارة

3.1 معلومات المنتجات: نبذل قصارى جهدنا لضمان دقة مواصفات الأدوات وأسعارها. في حال وجود خطأ في تسعير منتج ما، نحتفظ بالحق في إلغاء الطلب بعد إبلاغكم.

3.2 الأسعار والضرائب: جميع الأسعار معروضة بالجنيه المصري (EGP) وتشمل ضريبة القيمة المضافة (VAT) ما لم يُذكر خلاف ذلك.

3.3 التوفر: جميع الطلبات تعتمد على توفر المخزون. سنقوم بإخطاركم في حال عدم توفر أي منتج بعد إتمام الطلب.

3.4 الشحن والتوصيل: يتم تقدير مواعيد التوصيل بناءً على موقعكم الجغرافي داخل مصر أو دول الشرق الأوسط. "تولزي" غير مسؤولة عن التأخيرات الناتجة عن شركات الشحن الخارجية.

4. سياسة الاسترجاع والاستبدال (وفقاً للقانون المصري)

التزاماً بـ قانون حماية المستهلك المصري:

4.1 حق الاسترجاع: يحق للعميل استرجاع المنتج المادي خلال 14 يوماً من تاريخ الاستلام دون إبداء أسباب، بشرط أن يكون المنتج في حالته الأصلية وبتغليفه المصنعي ولم يتم فتحه أو استخدامه.

4.2 العيوب المصنعية: يحق للعميل استرجاع المنتج أو استبداله خلال 30 يوماً في حال وجود عيب صناعة أو عدم مطابقته للمواصفات المعلنة،

(وذلك من خلال القنوات الخاصة بوكيل الماركة ذاتها).

4.3 الاستثناءات: لا ينطبق حق الاسترجاع على المنتجات الرقمية (الدورات التي تم البدء في مشاهدتها)، أو الأدوات التي تم تصنيعها بناءً على طلب خاص، أو المنتجات التي تضررت بسبب سوء الاستخدام.

4.4 رد الأموال: يتم رد المبالغ عبر التحويل فقط على رقم حساب العميل او علي هيئه نقاط او رصيد للعميل يستطيع الشراء به مره اخري (دون حد اقصى لمهلة الشراء)، و ذلك خلال 14 يوم عمل من تاريخ استلام المنتج المرتجع و بعد إتمام عملية الفحص، مع تحمل العميل جميع الرسوم المسددة مثل عمولات التحويل، الضريبة و الشحن من المبلغ الشراء (إلا في حالة وصول منتج خطأ او غير مطابق للمواصفات )

5. الدورات التدريبية والمحتوى الرقمي

5.1 الترخيص: عند شراء دورة، تمنحك "تولزي" رخصة محدودة وغير حصرية لمشاهدة المحتوى للاستخدام الشخصي فقط.

5.2 القيود: يمنع منعاً باتاً تسجيل، تحميل، أو إعادة توزيع محتوى الدورات. أي مخالفة تؤدي لغلق الحساب فوراً والملاحقة القانونية.

5.3 المسؤولية: الدورات تهدف لتطوير المهارات، ولا تضمن "تولزي" نتائج مادية أو وظيفية محددة للمستخدم.

6. قواعد المجتمع (Community)

6.1 السلوك العام: يجب الالتزام بالاحترام المتبادل. يمنع نشر محتوى مسيء، سياسي، طائفي، أو ترويجي لمنافسين.

6.2 الرقابة: تحتفظ "تولزي" بالحق في حذف أي تعليق أو منشور يخالف سياسة المجتمع دون إنذار مسبق.

6.3 الملكية الفكرية للمستخدم: بمشاركتك في المجتمع، تمنح "تولزي" الحق في عرض محتواك وتحسينه وتوزيعه داخل المنصة.

7. حقوق الملكية الفكرية

جميع المحتويات الموجودة على المنصة، بما في ذلك الشعارات، النصوص، التصاميم، ومواد الدورات، هي ملكية حصرية لـ Toolzzy ومحمية بموجب قوانين الملكية الفكرية المصرية والدولية.

8. الخصوصية وحماية البيانات

نحن نلتزم بحماية بياناتك وفقاً لـ قانون حماية البيانات الشخصية المصري رقم 151 لسنة 2020. يرجى مراجعة [سياسة الخصوصية] لمعرفة كيفية جمع واستخدام بياناتك.

9. حدود المسؤولية

تُقدم المنصة "كما هي". لا تتحمل "تولزي" المسؤولية عن:

- أي إصابات ناتجة عن الاستخدام الخاطئ للأدوات المشتراة من المتجر.

- الانقطاع المؤقت للخدمة لأسباب تقنية أو تحديثات دورية.

10. القانون الواجب التطبيق

تخضع هذه الشروط والأحكام وتفسر وفقاً للقوانين السارية في جمهورية مصر العربية. وتختص محاكم القاهرة/الإسكندرية بالنظر في أي نزاع ينشأ عنها.

Welcome to Toolzzy. By accessing or using our website (www.toolzzy.com), mobile application, online store, community forums, and educational courses (collectively, the "Platform"), you agree to comply with and be bound by the following Terms and Conditions.

1. Introduction & Eligibility

2.3 Termination: We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activities.

3. Online Store & E-commerce Terms

3.1 Product Information: We strive for accuracy in descriptions and pricing. However, errors may occur. If a product is listed at an incorrect price, we reserve the right to refuse or cancel the order.

3.2 Pricing & Taxes: All prices are listed in Egyptian Pounds (EGP) and are inclusive of VAT unless stated otherwise.

3.3 Availability: All orders are subject to stock availability. We will notify you as soon as possible if a product you ordered is unavailable.

3.4 Shipping & Delivery: - Delivery times are estimates and may vary based on your location in Egypt or the Middle East.

Risk of loss and title for items pass to you upon delivery to the carrier.

4. Returns, Refunds & Cancellations (Egyptian Law Compliance)

In accordance with the Egyptian Consumer Protection Law:

4.1 Right of Return: You have the right to return any physical product within 14 days of receipt for a full refund, provided the item is in its original, unopened packaging and condition.

4.2 Defective Products: You have 30 days to return a product if it has a manufacturing defect, through brand official channel.

4.3 Exclusions: Returns are not accepted for digital products (once accessed/downloaded), customized tools, or items that have been used for hygiene/safety reasons.

4.4 Refund Process: Refunds will be processed via the original payment method or a Toolzzy wallet credit within 14 working days of receiving the returned item.

5. Courses & Digital Content

5.1 License: When you purchase a course, Toolzzy grants you a limited, non-exclusive, non-transferable license to access and view the content for personal use only.

5.2 Restrictions: You may not share your login credentials, download (unless permitted), record, or redistribute course materials. Violation will result in immediate account termination without refund.

5.3 No Guarantees: While our courses are designed to provide professional skills, Toolzzy does not guarantee specific employment or financial outcomes.

6. Community Guidelines

6.1 User Conduct: Our community is a place for professional growth. You agree not to post content that is:

-Defamatory, obscene, or hateful.

-Infringing on intellectual property rights.

-Spam or unauthorized commercial promotion.

6.2 Moderation: Toolzzy reserves the right to remove any content or ban users who violate community standards.

6.3 User-Generated Content: By posting on the community, you grant Toolzzy a non-exclusive right to use, display, and distribute that content across our platform.

7. Intellectual Property

All content on the Platform, including logos, text, graphics, course materials, and software, is the property of Toolzzy or its content suppliers and is protected by Egyptian and international copyright laws.

8. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy. We comply with the Egyptian Data Protection Law (Law No. 151 of 2020). We use your data to process orders, improve user experience, and for marketing (where consented).

9. Limitation of Liability

Toolzzy provides the Platform "as is." We are not liable for:

-Indirect, incidental, or consequential damages.

-Personal injury or property damage resulting from the misuse of tools purchased from our store.

-Technical interruptions or downtime.

10. External Links & Third Parties

Our Platform may contain links to third-party websites (e.g., payment gateways like Fawry, Paymob). We are not responsible for the content or practices of these external sites.

11. Google & Meta Compliance

11.1 Transparency: We do not engage in "bait and switch" marketing.
